General Terms and Conditions of Sale

CONDITIONS GÉNÉRALES DE VENTE (CGV)

PREAMBLE

These General Terms and Conditions of Sale (GTCs) are entered into between:

D’une part, la société Davless créations, SASU au capital de 100 €, immatriculée au RCS de Romans sous le numéro 995 143 468, dont le siège social est situé 3 Ruelle du Point du Jour, 26160 Saint-Gervais-sur-Roubion (ci-après le « Vendeur »). TVA Intracommunautaire : FR 23 995 143 468.

And, on the other hand, any natural or legal person making a purchase on the website davidlespect.com (hereinafter the “Buyer” or the “Client”).


ARTICLE 1: PURPOSE AND SCOPE OF APPLICATION

These GTCs govern the sale of cutlery products (handcrafted knives and “mid-tech” or manufactured series knives) and accessories via the website davidlespect.com.

The Client declares that they have read these GTCs prior to validating their order. Validation of the order constitutes unconditional acceptance of the GTCs.

Warning – Sale of knives: In accordance with French legislation (Article L311-2 of the Internal Security Code), the knives sold on this website are Category D weapons. Their sale is strictly prohibited to minors. By placing an order, the Client certifies on their honor that they are of legal age (over 18 years old).

ARTICLE 2: PRODUCTS

The products offered are of two types:

  1. Handmade Knives (“Custom”): Unique pieces or small series entirely or partially handcrafted by David Lespect. The photos are contractual for unique pieces, but natural variations (wood grain, horn, steel nuances) may exist.

  2. Production Knives (“David Lespect Design”): Industrially manufactured knives (notably in China) based on a design by David Lespect. These products meet strict quality standards.

Products are offered within the limits of available stocks. In the event of unavailability after the order is placed, the Seller will inform the Customer and proceed with a full refund.

ARTICLE 3: PRICES

Prices are indicated in Euros (€), all taxes included, including French VAT at the current rate.

Pour les ventes hors Union Européenne (Monde entier) : Le prix sera facturé hors taxes sur la facture finale (selon la configuration du site) ou TTC selon le statut fiscal du client. ⚠️ Important – Droits de douane : Pour toute livraison hors de l’Union Européenne (et vers les DOM-TOM), des droits de douane, taxes locales ou droits d’importation sont susceptibles d’être exigibles. Ces droits ne relèvent pas du ressort du Vendeur. Ils sont à la charge exclusive du Client et relèvent de sa responsabilité (déclarations, paiement aux autorités compétentes).

ARTICLE 4: ORDER AND PAYMENT

4.1. Process: The Customer validates their order after reviewing their cart. The sale is considered final after the order confirmation email is sent and payment is received.

4.2. Payment: Payment is made immediately upon ordering by credit card. Transactions are secured by the Caisse d’Épargne payment system (SSL/TLS protocol). The Seller never has access to the Customer’s confidential banking details.

ARTICLE 5: DELIVERY

The products are delivered to the address indicated by the Customer at the time of ordering.

5.1. Carriers:

  • For Metropolitan France: Shipments are handled by Colissimo (La Poste) with tracking and delivery against signature.

  • For International (Worldwide): Shipments are handled by DHL Express (or equivalent carrier) with tracking and delivery against signature.

5.2. Lead times: Timeframes are provided for information purposes only. The Seller undertakes to ship orders within 2 to 5 business days (excluding special order products). In the event of a shipping delay, an email will be sent to the Customer.

5.3. Receipt of the parcel: The Customer is required to check the condition of the packaging and the product upon delivery. In the event of damage (opened or crushed parcel, sound of breakage), the Customer must imperatively refuse the parcel or make specific handwritten reservations on the carrier's delivery slip and inform the Seller within 48 hours.

ARTICLE 6: RIGHT OF WITHDRAWAL

In accordance with Article L.221-18 of the Consumer Code, the Customer (private consumer) has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to justify reasons or pay a penalty.

Return procedure:

  1. Inform the Seller by email at: david@davidlespect.com.

  2. Return the product in its original condition (new, unused, in its complete packaging) to the registered office address.

  3. Return costs are the responsibility of the Customer.

Exception: The right of withdrawal does not apply to custom-made products or products clearly personalized at the Customer's request (specific engraving, non-catalog materials).

ARTICLE 7: WARRANTIES

All products benefit from the legal guarantee of conformity (Articles L.217-4 and following of the Consumer Code) and the warranty against hidden defects (Articles 1641 and following of the Civil Code).

The warranty does not cover:

  • Normal wear and tear of the knife (sharpening, scratches from use).

  • Damage resulting from abnormal use (prying, using as a screwdriver, dishwasher use, knife throwing).

  • Oxidation of carbon steels (non-stainless) which requires specific maintenance by the Customer.

ARTICLE 8: LIABILITY

The products offered comply with current French legislation. The Seller shall not be held liable in the event of non-compliance with the legislation of the country where the product is delivered (e.g., prohibition of certain types of blade locking mechanisms). It is the Customer's responsibility to check the import possibilities with local authorities.

The Seller shall not be held liable for damages resulting from misuse of the purchased product (cuts, injuries). Knives are sharp tools that must be handled with care.

ARTICLE 9: APPLICABLE LAW AND DISPUTES

These GTC are subject to French Law.

In the event of a dispute, an amicable solution shall be sought as a priority. 

Failing an amicable agreement, any dispute shall fall under the exclusive jurisdiction of the courts within the jurisdiction of Davless créations' registered office (Commercial Court of Romans), unless public policy provisions dictate otherwise.
